1. Services
Velcran provides AI-enabled customer-response, call handling, lead follow-up, appointment-support, workflow, and related consulting services. The exact features, channels, integrations, usage limits, fees, and support included in a customer’s service are determined by the applicable proposal, order, or written agreement.
2. Eligibility and account responsibility
You must be at least 18 and authorized to act for the business you represent. You are responsible for accurate account information, protecting credentials, maintaining compatible services and integrations, and promptly notifying us of suspected unauthorized access.
3. Customer instructions and compliance
You are responsible for the accuracy and legality of the scripts, service descriptions, pricing, availability, routing instructions, contact lists, and other information you provide. You must use the services lawfully and obtain any permissions or consents required for calls, recordings, texts, emails, marketing, data processing, and appointment communications.
4. AI limitations and human review
AI-generated responses can occasionally be incomplete or incorrect. The services are not a substitute for professional judgment, emergency services, legal advice, medical advice, or licensed trade advice. You must define appropriate escalation procedures and review important outputs, customer records, bookings, and operational decisions.
5. Response promise
Any Velcran response promise applies only to eligible calls successfully routed through an active Velcran AI receptionist during active paid service and is subject to the customer’s configuration and plan terms. It does not guarantee that every call will connect, convert, produce revenue, or result in a booked job. Exclusions may include carrier or internet outages, third-party platform failures, incorrect routing, customer-side configuration, suspended service, misuse, force majeure, and events outside our reasonable control.
6. Fees, billing, and cancellation
Fees, payment timing, usage charges, renewal terms, cancellation terms, and any refunds are stated in your proposal, order, subscription, or other written agreement. Unless otherwise required by law or agreed in writing, fees already incurred are nonrefundable.
7. Acceptable use
You may not use Velcran to violate law, impersonate others, send unlawful or deceptive communications, harass people, infringe rights, distribute malware, compromise security, interfere with services, or process prohibited or highly sensitive information without written authorization and appropriate safeguards.
8. Intellectual property
Velcran, RMS Mobile Consulting LLC, and their licensors retain rights in the website, software, workflows, designs, documentation, trademarks, and service materials. You retain rights in the content and business information you provide and grant us the limited rights needed to deliver, secure, and improve the services.
9. Third-party services
Our services may connect with telecommunications carriers, calendars, CRM systems, payment providers, AI providers, and other third parties. Their terms and availability may apply, and we are not responsible for interruptions or changes caused by third-party services.
10. Disclaimers
Except as expressly stated in a written agreement, the website and services are provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing.
11. Limitation of liability
To the fullest extent permitted by law, Velcran and RMS Mobile Consulting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost leads, lost revenue, lost data, or business interruption. Our aggregate liability relating to the services will not exceed the fees paid by you for the affected services during the three months before the event giving rise to the claim.
12. Indemnification
You agree to defend and indemnify Velcran and RMS Mobile Consulting LLC from third-party claims arising from your unlawful use of the services, your content or instructions, your failure to obtain required consent, or your violation of these Terms or another person’s rights.
13. Governing law and changes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. We may update these Terms by posting a revised effective date. Continued use after an update means you accept the revised Terms.
